Please find information below about our processing of your personal data (Art. 4 (2) of the GDPR) in connection with your application on our online application platform.

In conformity with the European General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG), we only process your data for the specific purpose of filling positions within our company. In general, the following possible reasons for processing apply: Processing for the purpose of preparing contractual relationships (Art. 6 (1) (b) of the GDPR), for upholding justified interests (Art. 6 (1) (f) of the GDPR) on the basis of your approval (Art. 6 (1) (a) of the GDPR).
Within SPITZKE SE, only those entities receive your data which are entrusted with the preparation and implementation of the application process. These are the staff in the personnel department and the departments in which a position is to be filled, its managers and senior staff. Your personal application data is not forwarded to other companies in the SPITZKE Group without your prior, express approval.
If necessary, we process and store your personal data for the duration of the application process. If an employment relationship/training relationship/internship results from the application process, the data is first stored further and transferred to the personnel file. Otherwise, the application process ends with the receipt by the applicant of a rejection. At the latest, data is deleted 6 months after receipt of the rejection. This does not apply if the processing and storage of your personal data is required in the specific case for the assertion, implementation or defence of legal claims (duration of a legal dispute).
Finally, the duration of storage also depends on the statutory expiry periods, which can for example be up to thirty years according to §§ 195 ff. of the German Civil Code (BGB), whereby the usual expiry period is three years.
Each data subject has the right to obtain information in accordance with Art. 15 of the GDPR, the right to correction in accordance with Art. 16 of the GDPR, the right to restriction of processing in accordance with Art. 18 of the GDPR and the right to data portability in accordance with Art. 20 of the GDPR. If the processing of your personal data is required in order to uphold our justified interests in accordance with Art. 6 (1) (f) of the GDPR, you may object to this processing in accordance with the statutory regulations in Art. 15 of the GDPR. Furthermore, you have the right to submit a complaint to a data protection supervisory authority (Article 77 of the GDPR) if you are of the opinion that your personal data is not being processed in a lawful manner. The right to complain exists regardless of any other administrative or legal remedy.
For you, there is no legal or contractual obligation to provide data. During the course of your application, you should only provide the personal data required for your inclusion in the application process and its implementation. Without this data, however, we have no choice but to refuse to include you in the application process.
We process the following data or categories of data that we receive directly from you: basic data (gender, name, address, telephone numbers and e-mail address; date and place and country of birth and if required, your maiden name, nationality, family status), data regarding your school education in detail, data regarding your education (including school, university, company training), data regarding the content of former/current employment, e.g. duties, performance data, positions held, passport photo, other data that you voluntarily provide by uploading it or sending it to us in another manner, such as your application letter, CV or certificates. Usage data: The following data is processed every time you visit the website, including data that does not conclude the application process: The IP address, the website retrieved, and the date and time of retrieval. Data protection legal information: Declarations of approval for the processing of personal data; declarations of the revocation of any approvals you may have given; declarations regarding the objection to the processing of personal data; declarations regarding the assertion of your rights to information, correction, deletion, restriction of processing.
We do not process any data or categories of data that we receive from third parties.
You have the right, for reasons that arise from your particular situation, to submit a complaint at any time against the processing of personal data relating to you, which is conducted on the basis of Art. 6 (1) (f) of the GDPR (data processing on the basis of legitimate interests). If you submit an objection, we shall no longer process your personal data, unless we can provide evidence of urgent grounds worthy of protection for the processing that override your interests, rights and freedoms, or the processing is used for the assertion, implementation or defence of legal claims.
